Position of the Krzysztof Kieślowski Film School of the University of Silesia in Katowice on royalties for creators for the use of their works on streaming platforms and VOD.
We express our deep opposition to the removal from the draft amendment of the Copyright and Related Rights Act of a provision that was intended to ensure creators are appropriately compensated for the use of their works on streaming platforms and VOD. Our concern stems from the worry about the future of young students. We must take responsibility for their sense of certainty in the profession they wish to pursue.
The actions of the legislators are contrary to the principle of appropriate and proportional remuneration, expressed in Article 18 of the Directive of the European Parliament and of the Council (EU) 2019/790 of 17 April 2019 on copyright and related rights in the digital single market and amending Directives 96/9/EC and 2001/29/EC. The principle expressed in this article aims to protect the interests of creators by ensuring they receive a fair share of the profits generated from the digital distribution of their works.
In the face of dynamic technological development and the digital media market, our priority should be to find a balance between protecting the rights of creators and ensuring access to culture for society.
